Terms of Service
Important legal notice: This application operates as a decentralized, local-first Progressive Web App ("PWA"). By interacting with or installing Ritmo, you acknowledge that you understand and explicitly agree to be bound by these provisions, which govern data persistence, intellectual property parameters, and third-party media stream integrations.
Section 01
Acceptance of Terms
Welcome to Ritmo ("the Application"). By accessing, installing, caching, or executing the Application as a Progressive Web App or via its deployment subdomains, you explicitly agree to comply with and be legally bound by these Terms of Service ("Terms"). If you disagree with any segment of these provisions, you must immediately terminate your usage and delete the local site footprints from your client components.

Nature of Service & MVP Status
Ritmo is an independent software application designed exclusively for educational, language-acquisition framework testing, and localized cultural commentary. The current iteration operates strictly as a Minimum Viable Product ("MVP"). Features, data schemas, media layers, and parsing interfaces may adapt, scale down, or change iteratively without prior notification, warning, or financial liability to the operator.
Section 03
Intellectual Property & Fair Use Declaration
Ritmo does not stream, host, rip, redistribute, or monetize commercial audio recordings, master tracks, or full copyrighted text scripts. The Application acts entirely under the provisions of Educational Fair Use (pursuant to 17 U.S.C. § 107 and applicable international commentary frameworks) for the sole purpose of real-time linguistic parsing, translational analysis, and phonetic instruction.
Copyright ownership disclaimer: All commercial music metadata, cover art images, track designations, and lyric extracts referenced throughout the Application are the exclusive property of their respective recording labels, management corporations, and performing artists. No transfer of copyright assets occurs within this workspace.
Users are strictly prohibited from utilizing the curated linguistic definitions, local schemas, or regional slang breakdowns compiled within the Application for automated text-scraping algorithms, commercial repackaging, or training external machine learning frameworks.
Section 04
Third-Party Media Integrations
To provide core functional utility, the Application relies on standard web protocols and public API configurations, including the YouTube Embedded Player framework (via react-player) and static media proxy hooks to pull album covers.
- Independent status: Ritmo is completely independent of, and has no affiliation, endorsement, sponsorship, or partnership with YouTube LLC, Google LLC, Spotify AB, or Apple Inc.
- External term compliance: When initializing audio streams, users are interacting directly with third-party servers and explicitly remain bound by the YouTube Terms of Service, Google Privacy Policy, and any respective music agreements tied to their hardware device.
- API availability: Because playback relies on public streaming routes, any structural modification, token deprecation, or access boundary implemented by third-party content platforms may permanently disrupt player functionality without liability to the developer.
Section 05
Data Architecture & Local Storage Disclaimers
To guarantee immediate rendering speeds and absolute privacy protection, the Application leverages a local-first storage architecture. By default, tracked hours listened, fluency milestones, and active filter selections are written and parsed directly inside the client's local browser context via native mechanisms like localStorage or IndexedDB.
- Data loss hazards: Because telemetry is sandboxed to your explicit device canvas, clearing browser cookies, formatting local caches, running cleanup software, or updating physical mobile hardware layouts will permanently wipe out your accumulated listening statistics.
- Sync limitations: Any transient token-based handshake mechanisms or multi-device sync keys provided in settings act via brief, non-persistent memory bridges (e.g., short-lived serverless key-value pairs). These keys do not establish long-term backend client accounts or server backups.
- No recovery warranties: Storage and tracking configurations are supplied on an
"as-is"and"as-available"basis. The developer is not liable for data loss, tracking inaccuracies, or synchronization errors.
Section 06
Acceptable Use Guidelines
You agree to utilize the Application solely for legitimate, non-commercial language acquisition study. You explicitly guarantee that you will not execute the following actions:
- Inject malicious scripts, exploit client routing, or attempt to decompile compiled structural layout bundles.
- Utilize automated scripts, headless configurations, or data-scraping hooks to mass export or dump the underlying
songs.jsonpayload engine. - Artificially obscure or edit away visible player branding tags, YouTube links, or native platform controls overlaid within the media playback frames.

Disclaimer of Warranties
THE APPLICATION IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. IN NO EVENT SHALL THE AUTHORS OR COPYRIGHT HOLDERS BE LIABLE FOR ANY CLAIM, DAMAGES OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.
Section 08
Limitation of Liability
To the maximum extent permitted by applicable law, the developer of Ritmo shall not be held liable for any direct, indirect, incidental, or consequential damages. This includes, but is not limited to, data loss, mobile carrier bandwidth overages or data plan consumption fees accumulated during hidden video tracking streams, or terminal runtime errors generated by your device's standalone PWA engine.
Section 09
Modification of Terms
The developer reserves the sole right to update, modify, or rewrite these Terms at any time. When adjustments take place, the version numbers and dates tracking modification points will increment. Your ongoing interaction with the software dashboard after an explicit version edit represents binding ratification of the modified provisions.
Section 10
Governing Law & Jurisdiction
These Terms, along with all operational privacy standards, shall be interpreted and governed under the laws of the State of Arizona, United States, without regard to conflict of law criteria. Any formal legal claim or dispute emerging from this application workspace shall be handled exclusively within municipal courts located in Scottsdale, Arizona.
